Employees unemployed for at least three years can withdraw all available FGTS credit

In addition to the extraordinary disbursement of the FGTS (Service Time Guarantee Fund), which authorizes the disbursement of up to R$ 1,000 from active and inactive accounts linked to the fund, workers without a formal contract, that is, they can work for at least three years, can withdraw all your money.

It is worth remembering that canceling the registration for three years of unemployment is a completely different situation to when the employee withdraws the FGTS after being dismissed without just cause.

It is valid that each position that the worker has with a formal contract generates another account in his name, linked to the guarantee fund.

In this case, all previous working accounts are considered inactive accounts (because they are no longer receiving deposits), while the current working account is considered active (active because they are receiving new deposits).

So, when the employee is fired without just cause, he cannot withdraw the entire FGTS balance, but rather the balance associated with the job, that is, from the account that was active. Therefore, if the worker has deposits from previous jobs, these deposits will still be linked to the FGTS.

Can unemployed people be entitled to withdrawals?

However, employees who do not work with a formal contract for at least three (consecutive) years guarantee the right to withdraw the entire FGTS balance from the Last Employment Account or Inactive Accounts.

Withdrawal is super easy in this situation, and you need to follow these two criteria:

  • Without a formal contract for at least three consecutive years;
  • The request must be made from the month of the employee's birthday after having worked for at least three years without a formal contract.

To do so, the application must be made at Caixa Econômica Federal, where the worker must present their identity documents, PIS/NIT/Pasep number and work card proving cancellation of registration for at least three years.

How do I check my FGTS balance?

The best way to check the available balance in FGTS accounts is through the FGTS mobile application provided by Caixa Econômica Federal. Here's how to run the query:

  1. Download the app on your Android or iOS cell phone
  2. Open the app, tap Enter the App and continue;
  3. Enter your CPF and tap Next;
  4. Enter your password and go to login (if you don't have a password or lost it, it can be recovered through the app itself);
  5. The home screen will show information about the companies you have worked for;
  6. Concluded! The balance and deposited amounts are displayed at the top of the screen. Click on it to see the transactions.
